BRIBERY ACT 2010

Every company or public organisation in the UK that allows bribery or corruption to take place in their organisation home or abroad now faces the prospect of unlimited fines or ultimately its Director’s face 10 years in Prison.

This is as a result of the Bribery Act 2010 one of the most significant pieces of legislation to affect businesses for a decade. Coverage

  1. individuals who or companies that offer, promise or give bribes, including to foreign public officials; •individuals who or companies that request, agree to receive or accept bribes
  2. companies that negligently fail to prevent their employees or agents from giving bribes; and company directors, managers, corporate secretaries and other similar company officers who consent to or assist in the commission of a bribery offence by their company

Scope Of Offences

  • UK companies, and public organisations ,citizens and individuals ordinarily resident here, wherever the offending takes place
  • foreign nationals or companies whenever an act or omission in England, Wales and NI
  • criminal liability of senior company management (personal) 10 years and unlimited fine

Giving Or Receiving A Bribe

  • offer, promise or give advantage to someone. •With the intention of inducing the person to behave improperly
  • as a reward for behaving in an improper manner
  • knowing or believing that the recipient’s acceptance of the advantage was improper
  • recipient who requests, agrees to receive, or accepts an advantage

Failure To Prevent Bribery

  • commercial organizations who carry out any part of their business in the UK
  • senior officers negligently fail to prevent bribery by its employees and agents in connection with the business
  • no need for employee or agent to be prosecuted
  • defense of demonstrating adequate procedures

Bribery of a Foreign Official

  • separate offence
  • offers, promises or gives an advantage to a foreign public official
  • not permitted or required under the laws of the official’s country
